1.VALIDITY OF GENERAL TERMS AND CONDITIONS

 

The terms “Sigma Mobile”, “we”, “us” and “our” refer to Sigma Mobile Sp. z o.o. registered in Poland under KRS 434475. Sigma Mobile Sp. z o.o. operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Sigma Mobile Esim is powered by Shopify, which enables us to provide the Services to you. 

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services. 
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. 

 

 

2.DESCRIPTION OF SERVICES

 

Sigma Mobile engages in the reselling of prepaid eSIMs. Customers register and procure their SIM cards via the Sigma Mobile website.

Acceptance of the general terms and conditions is required for utilizing Sigma Mobile services. The client, directly or via a service intermediary (Hotel, Travel Agency…), provides the following details on the Sigma Mobile website: Client Name, Address (billing address), Email address, Phone number.

 

Sigma Mobile aims, within reason, to tender a quality service to customers. However, an assurance regarding uninterrupted, timely, secure or error-free service is not extended.

 

In utilizing the Services provided by Sigma Mobile the Customer must abstain from actions that are abusive, illegal, or fraudulent; or that impair or damage the Network. Should a breach of obligations under this Section occur, Sigma Mobile retains the right to suspend the customer’s service utilization. Notification of such suspension will be relayed to the customer as soon as reasonably feasible. During suspension periods, all due charges under this Agreement related to the suspended Services remain payable by the customer.

 

3.START, DURATION, AND TERMINATION OF THE CONTRACT

 

The service contract between Sigma Mobile and the customer commences upon order placement on the Sigma Mobile website and concludes upon the customer’s receipt of the purchased eSIM. eSIM activation is dependent upon the Customer.

 

4.CHARGES AND PAYMENT

 

Sigma Mobile service payments are processed via debit/credit card and PayPal.

Transactions are conducted in PLN, EUR or USD. Debit/Credit card transactions are secured and processed by Sigma Mobile payment gateway partners.

 

All charges specified by Sigma Mobile are gross i.e. they are inclusive of VAT unless otherwise indicated.

In instances where the customer, in good faith, disputes an invoice or part thereof, Sigma Mobile must be notified of such dispute within 7 days of invoice receipt, detailing the rationale behind the dispute and, if feasible, the amount deemed to be accurate by the customer. The customer is not entitled to offset any of its claims against claims of Sigma Mobile, except in scenarios where the customer’s claims are undisputed or affirmed by a conclusive court verdict.

 

Post-purchase, the customer is required to provide an email address for the receipt of eSIM QR codes.

 

 

 

5. REFUND / CANCELLATION / MODIFICATION POLICY

Customers retain the right to seek a refund or replacement in instances where eSIM activation is hindered due to technical glitches originating from Sigma Mobile.

 

6. PRIVACY

 

All data rendered by customers during Sigma Mobile equipment utilization will be safeguarded in accordance with relevant privacy terms related to customer data.

All customer data retained by Sigma Mobile will be exclusively used for contractual fulfillment purposes and to inform customers regarding products allied to their contractual agreement. In this regard, customers explicitly consent to the dispatch of such information, inclusive of marketing purposes, in electronic form, e.g., via email. Consent revocation can be tendered at any time but must be conveyed in writing to Sigma Mobile, specifying the affected email addresses.

 

7. DISCLAIMER

Sigma Mobile shall not be held liable for compensation of losses or breach of contract under the following circumstances, should you be unable to establish a connection using Sigma Mobile or if the data connection service falls below expectations:

·        Data transmission interruptions due to malfunctioning of computer rooms or communication networks of telecom carriers,

·        Package interruptions occasioned by force majeure events such as typhoons, earthquakes, power outages, floods, wars, or terrorist attacks,

·        System interruptions due to hacking,

·        Faulty terminal devices,

·        Remote or specific regions and environments lacking signal coverage,

·        Areas devoid of network coverage, including subways, tunnels, basements, mountainous terrains, and seas.

 

8. SERVICE MANAGEMENT AND CONTROL

 

In instances where the abuse, misuse, depletion, wastage, or unjustified use of data negatively impacts the network experience of other users, the carrier may impose controls or stop on the misbehaving users, premised on the principle of fair use, to ensure proper data package service provision to all users.

 

9. LIABILITY AND WARRANTY

 

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in Poland.

 

Sigma Mobile absolves itself from liability for detriments arising from unavailability or occasional availability of the proposed service. No guarantee regarding constant network service availability is provided by Sigma Mobile.
